Terms of Service

Welcome to Estiq (“Service”, “Platform”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Estiq software-as-a-service platform, including any associated mobile applications, websites, and related services.

By creating an account or accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including individual subscribers and any organization that accesses Estiq on behalf of its members.

Estiq is a CRM and productivity platform designed for real estate professionals. The Service includes tools for customer and portfolio management, note-taking, voice transcription, automated insights, reminders, and match recommendations. Features labeled “Estiq” (such as “Estiq analizi”) are powered by automated analysis and may include machine learning.

We reserve the right to modify, add, or remove features at any time. We will notify you of material changes that adversely affect your use of the Service.

To access the Service you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at destek@estiq.app if you suspect unauthorized access.

Accounts are personal and non-transferable. You may not share your account with or assign it to any third party without our prior written consent.

Estiq is offered on a paid subscription basis. Plans are billed either monthly or annually, as selected at checkout. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel.

• Monthly plans are billed every 30 days from the subscription start date.
• Annual plans are billed once per year from the subscription start date.
• All prices are displayed in US Dollars (USD) and are exclusive of any applicable taxes.
• We reserve the right to change prices. Any price change will be communicated at least 30 days in advance and will take effect at your next billing cycle.

Payments are processed by a third-party payment processor. Your payment information is subject to their privacy policy and terms. We do not store full card details on our servers.

You may cancel your subscription at any time from your account settings or by contacting destek@estiq.app. Upon cancellation:

• Your access will continue until the end of the current billing period.
• No further charges will be made after the current period ends.
• Your data will be retained for 60 days after expiry, after which it may be deleted.

Cancellation does not automatically trigger a refund. Please refer to our Refund Policy for eligibility.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws and regulations.
• Reproduce, distribute, or create derivative works of the Service without our written permission.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Upload or transmit any malware, viruses, or harmful code.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Use automated means (bots, scrapers) to access or collect data from the Service without our consent.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

The Service and all associated content, including but not limited to software, text, graphics, logos, and trademarks, are owned by or licensed to Estiq and are protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any Estiq intellectual property.

You retain ownership of all data and content you upload to the Service (“User Content”). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process and store it solely for the purpose of providing the Service to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service is provided “as is” and “as available”. We may perform maintenance that temporarily interrupts availability; we will endeavor to schedule such maintenance during off-peak hours and notify users in advance.

To the maximum extent permitted by applicable law, the Service is provided without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, accurate, or meet your specific requirements.

Any insights, suggestions, or recommendations generated by Estiq analysis features are for informational purposes only and do not constitute professional legal, financial, or real estate advice. You are solely responsible for any decisions made based on such outputs.

To the maximum extent permitted by applicable law, Estiq and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from these Terms or the Service shall not exceed the total subscription fees you paid to us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Estiq and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We reserve the right to update these Terms at any time. If we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service immediately ceases.

These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
